Océano Profundo — Difusión Marina y Buceo, operating under the trade name Océano Profundo, is the entity responsible for the use and protection of your personal data. We are based in Mexico City, Mexico, and provide SCUBA diving instruction and aquatic expedition services.

This Privacy Policy is governed by Mexican law, specifically the Federal Law on Protection of Personal Data Held by Private Parties (Ley Federal de Protección de Datos Personales en Posesión de los Particulares — LFPDPPP) and its Regulations.

PERSONAL DATA WE COLLECT

To fulfill the purposes described in this policy, Océano Profundo collects the following categories of personal data:

Identification data:

  • Full name
  • Date of birth (to verify the minimum age required for courses)
  • Nationality

Contact data:

  • Phone number and/or WhatsApp
  • Email address

Health data (sensitive data):

In accordance with Article 9 of the LFPDPPP, we collect sensitive personal data related to your health, specifically:

  • Pre-existing medical conditions relevant to the practice of scuba diving (cardiovascular, respiratory, epilepsy, etc.)
  • Declaration of physical fitness for aquatic activities

The processing of health data requires your express consent. By signing the medical fitness form for diving, you grant that consent. This data is collected solely for safety purposes and will not be shared except in the event of a medical emergency.

Payment data:

We do not store credit or debit card information. Payments are processed via bank transfer or secure third-party electronic means. We only retain payment confirmation records.

Browsing data:

  • IP address
  • Browser type and operating system
  • Pages visited and time spent (through cookies — see section 7)

PURPOSES OF PROCESSING

Primary purposes (necessary for the provision of the service):

  • Enrollment, registration and administration of students in SCUBA diving courses
  • Organization and coordination of diving expeditions and trips
  • Verification of minimum medical fitness for safe diving practice
  • Issuing NAUI dive certifications in the student’s name
  • Communication related to contracted services (dates, requirements, logistics)
  • Billing and payment management
  • Handling requests, complaints and clarifications

Secondary purposes (you may object to these without affecting the provision of the service):

  • Sending information about new courses, expeditions and promotions
  • General interest communications related to diving and marine conservation
  • Use of photographs or videos taken during activities for promotional purposes on social media or our website (subject to express consent)

If you do not want your data to be processed for secondary purposes, you may communicate this at any time by writing to contacto@cursosdebuceo.com.mx.

TRANSFER OF PERSONAL DATA

Océano Profundo may transfer your personal data in the following cases, without requiring your consent where permitted by law:

  • NAUI Worldwide: For the registration and issuance of international dive certifications in your name, in accordance with the certifying organization’s standards.
  • Competent authorities: When required by court order, legal mandate, or for compliance with legal obligations.
  • Emergency services: In the event of an accident or medical emergency during diving activities, your data and health conditions may be shared with emergency services or medical personnel.

We do not share, sell or transfer your personal data to third parties for commercial or advertising purposes.

HOW TO EXERCISE YOUR ARCO RIGHTS

Under Mexican law, you have the right to Access, Rectify, Cancel and Object (ARCO rights) to the processing of your personal data, in accordance with the LFPDPPP and its Regulations.

Procedure to exercise your rights:

  1. Send a written request to contacto@cursosdebuceo.com.mx with the subject line: “ARCO Rights Request”.
  2. Include in your request: your full name, a clear description of the data on which you wish to exercise your right, documentation proving your identity (copy of official ID or passport), and where applicable, the changes to be made or the reasons for your objection.
  3. We will respond to your request within a maximum of 20 business days from receipt.

You may also file a complaint with the National Institute for Transparency, Access to Information and Personal Data Protection (INAI) if you believe your rights have been violated. More information at www.inai.org.mx.

MECHANISM TO REVOKE CONSENT

You may revoke your consent to the processing of your personal data at any time, provided this does not prevent compliance with legal or contractual obligations arising from an existing legal relationship between you and Océano Profundo.

To revoke your consent, send an email to contacto@cursosdebuceo.com.mx clearly indicating the data whose processing you wish to stop and the reasons for your request. We will respond within a maximum of 20 business days.

Important: Revoking consent for data strictly necessary for the provision of the contracted service (such as identification and health data for diving courses) may make it impossible to continue providing the service.
